Implementation of the Fair Usage Policy in India

Fair Usage Policy (FUP) helps keep a tab on customers’ data usage. The policy is adopted by Internet Service Providers (ISPs) and Telecommunications Service Providers (TSPs). The policy alerts them to reduce a user’s upload or download speed after the customer reaches a certain data cap.
The policy is fair as it asks the companies to provide services in a transparent manner and give all important information to the customers. The Telecom Regulatory Authority of India (TRAI) has directed that customers should be given information about all the plans and which FUP is applicable to each scheme. They also need to be notified when their data limit reaches levels of 80% and 100%. Besides, companies need to ensure that the speed doesn't go below the specified minimum.
It is also mandated that the conditions of all plans should be explicit in advertisements and not hidden in the small print. Besides, the advertisements should also provide a link for the users to check detailed plans on the company’s website.
Shortcomings in implementation
TRAI has mentioned that the companies should not cut down the speeds or charge extra when they use the word ‘unlimited’ in their plans. But many popular telecom companies and ISPs do not implement this rule. TRAI has been unsuccessful to regulate such malpractices.
In June 2015, a report from the content delivery network Akamai stated that India ranks 115th in the world on the basis of average internet speed. The condition of high-speed internet in India is pitiful. The recently launched Digital India initiative may change the scenario, but the government will have to be more strict and active in order for digitization to be fruitful in the country.
